Also known as “Fresh Start Bankruptcy,” and “Liquidation Bankruptcy,” Chapter 7 Bankruptcy is designed to help individuals with very few assets and little income obtain financial relief. We will sit down with you and review your income, possessions, and debts by running a “Means Test.”
Should we determine that you do not qualify to file under Chapter 7, you may still be able to obtain relief by filing for Chapter 13 Bankruptcy Protection.
Once it has been determined via the “Means Test” that you qualify to file for Chapter 7 Bankruptcy Relief, Attorney Robert Spitz and his staff of bankruptcy professionals will immediately begin drafting your Bankruptcy Petition for filing with the Court.
When your Chapter 7 Bankruptcy petition is filed, the Court will assign a bankruptcy trustee to oversee your case. Additionally, as soon as the Bankruptcy Petition is filed, we will notify your creditors that you are seeking Bankruptcy Relief and inform them that they must stop contacting you immediately.

Absent any challenges from creditors, the Bankruptcy Court will issue a discharge order stating that all qualifying debts have been discharged. Once this order is issued, creditors can no longer attempt to collect on any of these debts. You are provided with a fresh financial start, free of these debts.
